Peculiarities of proving at the stage of preparation to a judicial sitting on criminal case

The article researches the peculiarities of proceeding at the stage of preparation to a judicial sitting in the form of preliminary trial as well as peculiarities of proving at preliminary trial: correlation of proving of material and procedural circumstances. The question of presence of cognitive activity which exceeds the limits of proving one in the judge and parties actions is examined.
