Features of the mechanism of legal regulation in the provision of legal services in civil proceedings

The author notes that the following problems can be identified as features of the mechanism of legal regulation in the provision of legal services in civil proceedings: 1) problems of legislative allocation of a contract for the provision of legal services for a fee into a separate structure; 2) issues of regulating the features of the procedural status of certain categories of participants in civil proceedings; 3) the need for a more accurate and appropriate definition of the subject, terms and quality of legal services. It is proposed to supplement Art. 783 of the Civil Code of the Russian Federation should be worded as follows: “The law may provide for the specifics of rendering certain types of services…”, since the current version does not eliminate the significant legal uncertainty regarding whether the rules on contractual relations as the closest in their intended purpose can be applied to the provision of services for a fee.
