The subject of proof in the proceedings of a jury trial

The article examines the problematic issues of the subject of evidence in the proceedings of a jury trial. The issues of determining the limits of proof in a jury trial are considered, the possibilities of including in the limits of proof issues of the degree of guilt, circumstances entailing the release of the defendant from responsibility, as well as the identity of the defendant, other circumstances are highlighted. The conclusion is made about the shortcomings of the normative provision contained in Part 8 of Article 335 of the Code of Criminal Procedure of the Russian Federation. Attention is drawn to the practice of the European Court on the limits of evidence in proceedings in court with the participation of jurors.
