Features of crimes against life and health in the process of providing medical care

The article presents a study of approaches to identifying the specific features of iatrogenic crimes. The features of iatrogenic crimes are systematized. The specifics of subjective features of the criminal acts under consideration are determined. The analysis of the main difficulties in investigating crimes against life and health in the process of providing medical care, identifying cause-and-effect relationships is carried out. The possibilities of qualifying criminal acts in accordance with the current criminal legislation of the Russian Federation are determined. The features of careless causing of harm by several medical workers are established. The conditions for conducting a high-quality expert study on the features of committing an iatrogenic crime by several medical workers are determined. A conclusion is made on the need to develop and normatively consolidate a certain algorithm (methodology) for criminal-legal assessment of causal relationships of causing harm or death through negligence, especially with respect to the actions of several medical workers, which can be set out both in regulatory documents of the Ministry of Internal Affairs of Russia and in explanations of the Plenum of the Supreme Court of the Russian Federation. The indicated approaches will allow law enforcement and judicial authorities to correctly determine the presence of a causeand- effect relationship between the defects in medical care committed by medical workers and the resulting consequences.
