Features of criminal prosecution of top managers and heads of the organizations

Purpose: To study the peculiarities of law enforcement practice in case of criminal liability for crimes committed in the sphere of entrepreneurial activity, managers and top managers of organizations. Methodology: We used the formal legal method, the method of comparative analysis. Results: This article examines the basic mechanisms of criminal law and legal practice that prevent the unlawful bringing of managers and members of the governing bodies of legal entities to criminal liability. It is concluded that the trend towards the use of criminal prosecution of managers as an instrument of pressure on business in resolving economic disputes is maintained. Novelty/originality/value: The topic considered in the article has a special relevance and significance for practicing lawyers. The results will contribute to the improvement of legislation and legal proceedings.
