Features of investigative proceedings upon receipt of information, constituting a legality protected patient confidentiality

This article discusses the issues of investigative proceedings upon receipt of information constituting a legality protected pa- tient confidentiality. The article authors has noted that the lack of uniformity of legal regulation of investigation which may be or needs to be obtained information constituting a legality protected patient confidentiality, they lead to inconsistencies in practice implementing them. Based on the analysis of normative legal acts and empirical evidences it is concluded that the decision of the Supreme Court of the Russian Federation in the part containing patient confidentiality and information that may contain patient confidentiality, they must be a legal basis for investigators in the choice of procedural methods for obtain the objects, containing the appropriate information, and they serve as a means to achieve uniformity of legal regulation of the procedure of the reporting of the proceedings.
