Features of the investigation of illegal access to computer information (art. 272 of the Criminal Code of the Russian Federation)

The article discusses the features of the investigation of unlawful access to computer information provided for in Article 272 of the Criminal Code of the Russian Federation, concerning the proof of the fact of unlawful access to computer information, the consequences of unlawful access in the form of copying, blocking, deletion, modification of computer information, proof that the information accessed is protected by law, the implementation of unlawful access suspects, characteristics of the criminal’s personality (official position, self-interest), etc. The functioning of these elements is demonstrated by the example of an investigated criminal case. The study concludes that the process of proving the guilt of a person who committed unlawful access to legally protected computer information by copying requires employees investigating a criminal case to carefully record the actions of the user of this service.
