The Constitution of the Russian Federation recognizes the priority of the rights and freedoms of man and citizen over all other values of the society and state. Article 2 of the Constitution of the Russian Federation establishes, that the recognition, observance and protection of human and civil rights and freedoms are the responsibility of the state. The authors give great importance to freedom of literary, artistic, scientific, technical and other kinds of creativity in the system of human and civil rights and freedoms. This freedom is reflected also in international legal acts such as the Universal Declaration of Human Rights 1948 and the International Covenant on Economic, Social and Cultural Rights, 1966. The implementation of freedom of creativity is primarily based on the guarantees embodied in the Constitution of the Russian Federation. Thus, freedom of creativity implies the inadmissibility of ideological uniformity, control and censorship by the state. The authors describe artistic freedom as man’s ability guaranteed by constitutional norms to create literary, artistic, scientific and other works.
