Features of the theory of balance of contractual legal relations

Бесплатный доступ

In the course of research in the field of the theory of balance of public and private interests, a legal phenomenon was revealed - the reality of contract performance. The reality of contract performance provides, first of all, for the achievement of the goals of its parties. At the same time, not only private interest, but also public interest should achieve the set goal, which will ultimately act as a real physical object. Mutual achievement of goals by public and private interests, in our opinion, is substantiated as a reasonable balance of interests, that is, such a state of interests when their goals are achieved, the contract is actually executed, and there are no objections to the execution of essential conditions.
