To the author' opinion under a procedure on criminal cases a court is a subject of a proof duty, which unlike the bodies of criminal prosecution possesses the special proceeding powers in the sphere of proof activity. A state and a competence of a court as a subject of a proof duty are conditioned from one side by the legal regulations of general character. From another side the powers of a court as a subject of proof duty are dictated by the laws of the CPC of the Russian Federation, regulating the court procedure on criminal cases.
