Special proceeding. Concept, essence and types

In this article the author examines the theoretical and practical aspects of the definition “special production” and its separation into Subsection IV of the Civil Procedure Code of the Russian Federation, as well as its essence and types. The author also identifies the main features of a special proceeding, based on certain specific criteria. Detects special features of proceeding for each category of cases, which is regulated be setting certain procedural exemptions and additions. This may be connected with emergence, modification or termination of rights or obligations.
