Бесплатный доступ

The article discusses topical issues of challenging transactions in the bankruptcy procedure of individuals, in particular, replenishing the bankruptcy estate of the debtor from the debtor's right to claim against a third party, arising from challenging the debtor's transactions in the insolvency (bankruptcy) procedures of a legal entity and an individual. The author considered two possible options in which the arbitration manager can extract a larger amount of funds from the debtor's right to claim against a third party. The problem of devaluation of the rights of claim of the debtor as a creditor against his counterparties in the sale of such a right of claim at the auction is also considered. The main attention is paid to the ways of abuse of the granted right by the debtor.
