The article discusses the issues of exemption from the obligation to testify as a constitutional principle of criminal proceedings. Testimony, being the most common sources of evidence, often plays a key role in establishing circumstances that are important for the correct resolution of a criminal case. In this context, there is a close relationship between the norms of criminal and criminal procedural legislation, which originate from Article 62 of the Constitution of Turkmenistan, according to which a person cannot be forced to testify against himself and close relatives.
