The article deals with relatively new objects of rights - digital financial assets and digital currency. It notes the importance of studying them due to the fact that in the near future they may become a central element of the modern economy. The article examines the issues of legal regulation of digital financial assets and digital currency circulation in the Russian Federation, as well as in other countries. Materials and methods: the study is based on a comparative legal analysis of the norms of international and national law, a combination of formal legal, sociological and other private scientific methods of cognition. The results of the study: conclusions are drawn about the place of digital currency and financial assets in the legal field of the Russian Federation, the specifics of the terminology used are disclosed, it is concluded that digital currency is a property of a special legal nature, the need for more precise legislative regulation of digital currency and financial assets as objects of legal relations has been identified. Findings and Conclusions: the use of terminology in different legal acts is ambiguous; digital currency is not outside the legal field on the territory of the Russian Federation, but is regulated by civil law as property of a special legal nature, falls under the concept of other property; only a clear legislative regulation of digital currency and financial assets as objects of legal relations can create certainty in resolving a number of issues, including protection issues.
