Some problems of participation of a psychologist and pedagogue in criminal proceedings

Introduction. The article studies the participation of a teacher and (or) psychologist in investigative actions. By studying this issue, existing problems are formed that prevent the effective use of the capabilities of a psychologist and (or) teacher during the preliminary investigation. As part of the study, an analysis of relevant scientific works, legislation and law enforcement practice is carried out to determine the possibilities of solving existing problems. Materials and Methods. In the course of the study, general scientific and specific scientific methods were used, which made it possible to reveal in detail the existing problems of the participation of a psychologist and (or) teacher in investigative actions, to analyze the current situation from the standpoint of science and practice, and to determine further ways to improve and overcome problems in this area. The Results of the Study. In the course of the study, problems were identified that prevented a psychologist and (or) teacher from working effectively during investigative actions and the investigation process as a whole. It was established that at present there are problems in defining the tasks of the participation of a psychologist or teacher at the stage of preliminary investigation; issues of legislative regulation of the activities of a teacher and psychologist; tasks of informing teachers and psychologists about procedural rights; questions about professional and other requirements imposed on teachers and psychologists; complex aspects of finding teachers and psychologists in organizations and resolving issues with their employers; resolving other organizational issues of participation of a psychologist and teacher. Findings and Conclusions. In conclusion of the article, the authors come to the conclusion that these problems can only be solved comprehensively. As such a solution, the following is proposed: high-quality consolidation in various written sources of the entire set of information necessary for the effective work of a psychologist and (or) teacher in investigating crimes; a change in the approach of investigative and other law enforcement agencies to the role of a psychologist and (or) teacher as a person capable of increasing the effectiveness of a crime investigation; understanding by a psychologist and teacher of their role in conducting a specific investigative action or in the investigation process as a whole.
