Certain issues of implementation of the judicial reform of 1864

Introduction: the paper examines some aspects of the formation and development of judicial system of Russia in a period of Great judicial reform of 1864 the thesis that judicial reform in a series of other reforms of the period under review had the greatest impact on the development of Russian legal society of the second half of the XIX century as contributed to the formation of common standards of justice, which became the basis for the further development of the Russian judicial system. Materials and Methods: methodological basis of the paper is descriptive, scientific-analytical, historical-legal, theoretical-legal methods, analysis and synthesis within the limits of historical analysis. Results: the relevance and justification of the criminalization of acts is emphasized. This justifies the redundancy of Art. 110.1 of the Criminal Code of the Russian Federation, due to the objective possibility of establishing responsibility for declining and assisting suicide in Art. 110 of the Criminal Code. Analyzed ways to bring to suicide, declination to commit suicide and facilitate the commission of suicide. The list of common characteristics for these acts is supplemented. The categories of new crimes are being revised. Due to this the fundamental principles of the modern justice were established, namely, by administration of justice by designated authority, court; publicity of juridical process, equality of all before the law and court, legacy, respect for the individual, right to judicial protection etc. Discussion and Conclusions: the author made proposals for the regulation and differentiation of criminal responsibility of bringing to suicide and facilitating its commission. A new version of Article 110 of the Criminal Code is being developed аmong other сonclusions.
