Restriction of assignment and expense from other acts: issues of criminal legal qualification

The article examines some topical issues for the investigative and judicial practice of qualifying acts containing signs of appropriation and embezzlement as a variety of theft of someone else's property, with the emphasis on delimiting these crimes from fraud and theft. It is noted that one of the most important actions during qualification is to establish the presence or absence of the selfish orientation of the act, the authority of the guilty party to dispose of entrusted property, the ability to exercise such authority. The authors illustrate their judgments with examples from law enforcement practice.
