The distinctive features of category "weak party in civil legal relationship"

Purpose: Revelation and researching of main distinctive features, which let to define the weak party in civil legal relationship. Methodology: There were used methods of analysis and generalization, formal-logical, comparative-legal and historical-legal in this article. Results: The article was based on the analysis of the Russian and foreign legislation, its implementation, as well as scientific point of view, a system`s features of weaker party in civil legal relations: economic, organizational capacity; weak bargaining power; inexperience, lack of professionalism in the field of the contract, as well as legal incompetence or ignorance; incompetence in technical matters of the agreement; need at the conclusion of the contract, including the difficult financial situation and other difficult life circumstances; increased interest in joining the civil matter; abuse of the right of the counterparty, and others. Novelty/originality/value: The research has a high scientific value, seeing it`s one of the first attempts to make the system of the weak party`s features in civil matter.
