Removing a child from parents at a direct threats to his life or health as a mechanism of social protection of childhood in Russia

This article highlights the problems of law enforcement that arise in the implementation of the provisions of Art. 77 of the Family Code of the Russian Federation, which reveals the mechanism for taking children away from their parents in the presence of an immediate threat to their life or health. In particular, questions of the ambiguity of the wordings available in the rule of law are raised, the shortcomings of the procedure for selecting children are listed, as well as the existing ways of circumventing it by officials of state bodies. As a result of the study, an analysis is made of the draft federal law previously considered by the State Duma, which envisaged the introduction of significant changes in the procedure for taking children away from their parents, established by Art. 77 of the Family Code of the Russian Federation, and it is concluded that it needs to be reformed.
