Liability for organizing illegal migration in the EAEU countries' criminal legislation

The article analyzes the criminal legislation of the member states of the Eurasian Economic Union in terms of regulating responsibility for organizing illegal migration. Attention is drawn to the fact that the legislators of these countries have different approaches both to the definition of features of the organization of illegal migration, the establishment of its qualifying characteristics, and to the scope of punishability of this socially dangerous act. Reference is made to the fact that in Armenia, for example, there is no corresponding article in the criminal law at all. In the author's opinion, in order to ensure effective counteraction against illegal migration in the EAEU space, the norms on criminal liability for organizing illegal migration should be unified. In particular, this involves reassessing the degree of social danger of the act in question, reviewing the content and number of aggravating circumstances of the act, as well as the types and amounts of penalties.
