Original nature of the reality of criminal justice as it is

The author analyzes the assignment of criminal proceedings from the perspective of realistic approach to the modern Russian state policy in the field of detection, investigation, exposure of crimes and criminal proceedings. The author shows the discrepancy between the announced declaration of protective criminal justice and real practice, but also on the basis of economic dimension of criminal procedure. It is proposed to break from the current practice in theory to attempt explaining the difficulties arising out of law itself and turn to analyze the original nature of the reality of criminal justice.
