Beating: new edition - new problems

Having identified the trends in reforming the norms providing for liability for beatings, the author critically evaluates Part 2 of Art. 116.1 of the Criminal Code of the Russian Federation, introduced by Federal Law No. 203-FZ of June 28, 2022, containing a phrase that does not meet the requirements of legal certainty - “a crime committed with the use of violence”. Arguments are given that make it doubtful that the criminalization of beatings inflicted by a person with a criminal record fully ensured the fulfillment of the requirements of the Constitutional Court of the Russian Federation to bring Art. 116.1 of the Criminal Code of the Russian Federation in accordance with the Basic Law. According to the author, the contradiction revealed in the process of constitutional control once again gives reason to think about the validity and necessity of fixing the norms with a prejudicial element and the expediency of partial decriminalization of beatings.
