The article deals with the incitement to genocide as a separate crime. The author sites the judicial practice of the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR). By studying the cases, the criteria of incitement are discussed. Also, the author correlates the incitement to genocide and the freedom of speech.
