This article analyzes the issues related to the legal status and the regime of police activity in the criminal process of the Russian Federation. Readers ‘attention is drawn to the imperfection of the normative legal regulation of these issues in Article 40 of the Code of Criminal Procedure of the Russian Federation and in Federal Law No. 3-FZ of 07.02.2011 «On the Police», which, in the author’s opinion, need a serious semantic update.
