Introduction: the article is devoted to some problems arising in law enforcement, due to the lack of proper of criminal procedural regulation of the powers of the head of the expert institution in the appointment and production of forensic examination. Materials and methods: the normative basis of the study is formed by the Constitution of the Russian Federation, Federal laws, subordinate normative legal acts regulating the procedural status of the head of the expert institution. The methodological basis of the study was the General dialectical method of scientific knowledge, methods of logical deduction, induction, comparison, analysis, generalization and description. Results of the study: on the basis of the analysis of the normative legal acts regulating powers of the head of expert institution at appointment and production of examinations in criminal cases, and special literature the conclusion about existence of gaps in criminal procedural regulation of the procedural status of the head of expert institution is made...
