Placement in a Medical Organization Providing Psychiatric Care in Stationary Conditions: Issues of Legal Nature and Application Practice

The article considers the problem of the legal nature of the temporary placement of a person in respect of whom proceedings are underway for the application of a compulsory medical measure in a medical organization providing inpatient care. Certain conclusions are drawn, reflected in the article, that this procedural decision and procedural action should be considered as a measure of criminal procedural coercion. Based on the study, proposals have also been made to improve the current criminal procedure legislation of the Russian Federation. The article has scientific value and practical significance, since it examines for the first time the legal nature of the temporary placement of a person in respect of whom proceedings are underway for the application of a compulsory medical measure in a medical organization providing inpatient care and its place in the system of current criminal procedure legislation.
