The concept and essence of the balance of interests of the parties to the obligation

The author analyzed the essential features of the balance of interests of the parties to a civil-law obligation. On the basis of the identified features the definition of the concept of “balance of interests” is developed. The author summarizes approaches to understanding the categories of “interest”, “balance”, and also reflects the levels of regulation of social relations, at which the balance of interests is achieved: legal and individual.
