The concept of the institution of mediation

Mediation is a way of resolving disputes, deeply rooted in the history of the development of human relations, but it emerged as a modern technology for dealing with conflict situations only in the second half of the twentieth century. With all the variety of similarities with other forms of resolving differences, mediation has several fundamental differences. The main one is the presence in the proceedings of a third neutral party that does not make any decisions, but participates, understands, studies the problem and facilitates decision-making by the conflicting parties themselves.
