Implications unauthorized construction: demolition of buildings or legalization

The author examines the practice of courts of arbitration for disputes concerning the fate of properties that were built with a breach of public order the construction or in the absence of rights to land from the person who created the object. The cases of demolition of such buildings, the possibility of legalization (the establishment of property rights in the courts) in light of the explanations given by the higher courts. It is concluded that in these documents is an attempt to reach a reasonable compromise between the economically viable legalization of unauthorized buildings and construction of public policy, as well as the interests of persons whose rights have been violated conservation of such objects.
