The victim as a subject of the institute of reconciliation in the criminal proceedings of the Kyrgyz Republic

The article highlights the subject-object criteria for the admissibility of the implementation of conciliation procedures in criminal proceedings in the Kyrgyz Republic. In order to ensure the maximum completeness of protection and protection of the rights of the victim, it is proposed to consolidate the results of reconciliation (including through mediation) by recognizing and approving the relevant agreement exclusively by the court. In order to provide the subject of the crime with the opportunity to fully compensate for the harm caused by the crime, it is proposed to ensure the possibility of suspending legal proceedings for a clearly defined period during which the subject of the crime will be able to fulfill his obligations. Criteria have been developed for the dependence of the criminal procedural status of participants in criminal proceedings on the legal status of an individual, allowing to specify the specifics of concluding and implementing a reconciliation agreement in the interests of the fullest possible protection and protection of the rights and legitimate interests of the victim, as well as humane treatment of the subject of the crime.
