Positive administrative proceedings: the concept, signs and place in the system of administrative procedure

For several decades, there have been active scientific discussions on the issues of administrative procedural law, due to the lack of a generally accepted theory of administrative process. In the article, the author considers theoretical issues related to the content and essence of «positive administrative proceedings» as one of the structural elements of the system of administrative process of the Russian Federation; the conceptual apparatus of the system of administrative process is investigated, as well as the relationship between the concepts of «proceedings» and «procedure» in the context of determining the place of this legal phenomenon. The author’s concept of «positive administrative proceedings» is proposed.
