Practical aspects of using an English-speaking interpreter in criminal proceedings

Criminal procedure related to the investigation and subsequent resolution of criminal cases in court for various categories of crimes is often associated with the need for special knowledge. Especially when it comes to the collection, verification and evaluation of evidence, which requires the use of knowledge that, as a rule, participants in criminal proceedings with authority do not possess. Such specific knowledge in science and practice is referred to as “special”, and persons who possess it are referred to as “specialists” or “knowledgeable persons”. Of course, this participant in criminal proceedings plays an important role in the implementation of justice tasks, which necessitates the theoretical development of the procedural position of the specified subject. The article is devoted to the current issue of participation of an English-speaking translator in criminal proceedings. The importance of the principle of the language of criminal proceedings cannot be underestimated, since it directly establishes the procedure for verbal communication, as well as the mechanism for protecting the rights of participants in criminal proceedings who do not know or do not know enough the language in which criminal proceedings are carried out. According to its purpose, criminal proceedings begin with the choice of the language in which the proceedings will be carried out. An important element of the implementation of the mechanism of the language of criminal proceedings is the participation of an interpreter in a criminal case. Proper provision of this right to participants in criminal proceedings is an integral part of the principle of the language of criminal proceedings.
