In connection with the cessation of the functioning of the Marxist-Leninist, the so-called materialistic doctrine of social development, the article analyzes the methodological gap that has been discovered in the theoretical and methodological part of national legal science. The article justifies the need for a transition to a new social science theoretical and methodological approach in researches of state law phenomena.
