The right to receive and use genetic information in genetic testing and gene therapy: information and legal aspects

Purpose: The article is to study the problems of realization of the right to receive and use genetic information. Methodology: Basis of the work is a systematic approach, methods of analysis and synthesis, comparative law. Results: The analysis made it possible to conclude that genetic information requires the introduction of new special mechanisms for both legal and technical protection of genomic information. The development of new rules for the circulation of genetic information should be linked to the development of the complex institute of law. Novelty/originality/value: Genetic information differs from other protected personal data and medical confidentiality regimes and involves the new introduction of special legal protection mechanisms.
