The right of employees to training and additional professional education

The article deals with the right to vocational education of employees, as one of the most important rights, the importance of which will constantly increase in the age of rapidly developing technologies. The need for lifelong learning is undeniable today. This is a guarantee of safety not only for the employee, but also for the employer. The state should take care of the fate of its citizens, about the future of the country, which needs qualified personnel, professionals in their field. The regulation of relations related to training and professional education can be based on the mechanism of social partnership. Legislation on vocational education should contribute to the strengthening of educational elements in the content of acts of social partnership and in labor contracts. At present legal mechanism of social partnership in the field of vocational education has already been launched. Social partners take on mutual obligations regarding employment, training and further professional education, guarantees and benefits for those who combine work with training. These obligations are fixed in the acts of social partnership at various levels (Article 41.46 of the Labor Code of the Russian Federation). The right to education is enshrined in the Constitution of the Russian Federation, the Labor Code of the Russian Federation and other regulatory legal acts. This right is reflected in the Conventions and Recommendations. ILO. Legal relationship for the training and further professional education of employees directly with the given employer, being a derivative of the labor relationship, is included in the subject of labor law. Training and additional professional education is carried out in various forms. One of the forms of training and further professional education directly with the employer is a student agreement, the legal nature of which has still not been determined. There are two types of student agreement. One can conclude a student agreement with a job seeker as well as with an employee of the organization. For employees studying on the job, the legislator provided for guarantees and compensations, which are enshrined in the Labor Code of the Russian Federation. Today, the requirements for vocational education have changed; it should become a completely different one. The system of vocational education should change to meet the requirements of the people of working age throughout their entire working life.
