A child’s right to choose a parent: correcting age criteria and taking into account the minor’s opinion

The article considers the legal aspects of taking into account the child’s opinion in resolving family disputes about the place of residence. The authors propose to revise the age threshold of the child’s will, to introduce mandatory psychological expertise to eliminate parental pressure, as well as to unify the standards of work of courts and guardianship agencies. The authors substantiate the need for a systematic updating of law enforcement practice, taking into account the accelerated development of children and the exclusion of subjectivity of court decisions.
