Examining individual issues of abuse of active competition, the authors consider the institution of competition in various aspects: as a constitutional principle, as a type of procedural activity, as a way of examining evidence and as a form of proof in court. Adversarial proceedings are thus defined as a unified order and fundamental organization that can be abused by a party involved in the process in any type of legal proceedings.
