Law formation and lawmaking in the Russian Federation, problems of relationship

Бесплатный доступ

From the position of the traditional integrative-consistent concept, it was concluded that not every legal formation passes or ends with law-making, but only one that corresponds to actually established social relations, recognized values and constitutionally enshrined provisions. Lawmaking and legal formation are viewed as continuous and interconnected processes, rather than a rigidly staged “fixed” development. The shortcomings of the ideal theoretical model prevailing in the literature in a managed democracy are revealed. Conclusions are drawn about the interests in developing new regulation or improving the existing one, as well as the relative passivity of the majority of society.
