Legal relations for the transfer of residential premises for use: problems of qualification

The article analyzes the possibility of classifying the activity of transferring residential premises under a lease agreement as an entrepreneurial one. The author divides economic activity into active and passive. Considers active activity as entrepreneurial, and passive - as other economic activity that is not entrepreneurial, but which, under certain circumstances, can be qualified as entrepreneurial. He concludes that the transfer of residential premises under a lease is not an entrepreneurial activity, but if it is established that the purpose of acquiring a residential premises is not related to meeting the personal needs of the owner, then the rules on entrepreneurial activity can be applied to him.
