An urgent task of the Russian Federation at the present stage of its development is to find the optimal balance in the use of legal theory, legislation and practice of the achievements of the world legal thought and development of a new point of view on the institutional and functional aspects of the domestic legal system on the basis of the specifics of the Russian state, as well as the history of the domestic law in light of the legal tradition. Problems of development and interaction of different cultures, including legal culture as a multifunctional element of the legal system in the context of globalisation. Dual nature of the process of globalisation in cultural sphere reflected in the national legal system. On the one hand, it is universalisation, unification, convergence of various cultures, on the other hand, individualisation of certain national cultures. As a basic condition for further state legal development of the Russian Federation the author mentions finding the optimal balance in the usage of the achievements of domestic legal science and the experience of the world’s legal thought.
