The Legal Nature of Voluntary Informed Consent for Medical Intervention in the Aspect of Constitutional Rights of Citizens

This article attempts to analyze the content and legal nature of voluntary informed consent to medical intervention from the perspective of constitutionally enshrined human and civil rights and freedoms. The study highlights the relationship between the principle of personal autonomy, the right to dignity, and the institution of voluntary consent. The key components of voluntary consent to medical intervention, as established by Russian legislation and international legal instruments (including the 1997 Oviedo Convention, the European Convention on Human Rights, and rulings of the European Court of Human Rights), are examined. Based on legal practice and doctrinal sources, the article concludes that all three components of voluntary informed consent must be present when providing any type of medical care. Additionally, the article addresses relevant issues and problem areas that may serve as promising directions for future research.
