The legal nature of treatment, medical and social rehabilitation of convicted drug addicts

The study analyzes the legal nature of treatment, medical and social rehabilitation undergone by drug addicts. These measures can be assigned to a convict by a court pursuant to Article 72.1, Part 5 of Article 73, Part 2 of Article 79, Article 82.1 of the Criminal Code of the Russian Federation. The research reveals the common features of medical measures suggesting that the institution of medical treatment and rehabilitation of drug addicts is the independent legal institution. The author’s definition of such measures is given. The focus is on treatment goals, medical and social rehabilitation of convicted drug addicts. It is proposed to improve the legislative structure of Articles 72.1 and 82.1 of the Criminal Code of the Russian Federation as well as the procedure for providing compulsory treatment stipulated in Article 18 of the Penitentiary Code of the Russian Federation.
