The article is devoted to the consideration of the legal nature of custody and guardianship of children who have lost parental care. Since 2024, legislation in the field of family policy, including guardianship and guardianship, has undergone significant changes. All powers in the field of family policy were transferred to the Ministry of Labor and Social Protection of the Russian Federation. The implementation of the roadmap measures will make it possible to implement a unified state and family policy, including the sphere of guardianship and guardianship of minors, to form uniform law enforcement practices and ensure uniform standards for financing the activities of institutions, and to reduce the number of transfers of children from one institution to another when they reach a certain age.
