Legal nature of the percentage for illegal usage of other's money resources in terms of function-target and structured-target analysis

The author makes function-target and structured-target analysis of the legal nature of the percentage for illegal usage of other's money resources, and on the base of the analysis she makes a conclusion that it is not possible to refer the given percentage to the civil-liability measures. The author elaborates some offers on the current legislation improvement which allows classify the percentage provided by the article 395 of the Civil Code of the Russian Federation as a civil protection. The author also analyses theoretical and practical aftereffects of the given classification.
