The article examines the legal nature of a smart contract. The doctrinal positions formed to date on this issue in Russian legislation are considered. It is noted that there is a lack of law enforcement practice assessing such agreements as a legal phenomenon, as well as the fact that despite the lack of a legal definition, this term is often used in regulations. The author concludes that a smart contract is an electronic form of an agreement (transaction), equivalent to a simple written form.
