The legal nature of subsidiary liability. Application of civil law rules in bringing controlling persons to justice in the context of bankruptcy

This article discusses the issues of subsidiary liability, its features and the grounds for bringing third parties to it. Direct emphasis is placed on the responsibility of the controlling debtor of the persons in the official recognition of its insolvency. Thus, in addition to studying the features of additional liability in a generalized form, such a legal phenomenon as bankruptcy is studied and the scheme of bringing additional persons to responsibility in case of inability to fulfill obligations by the main debtor is considered in detail.
