The legal problem of the presumption of consent to the removal of human organs and tissues

The article is devoted to the problem of refusal to remove organs and tissues during posthumous donation, the provisions of legislation in the field of transplantation are considered. Judicial practice is also given in the refusal to satisfy the claim of relatives of deceased citizens whose organs were seized without their knowledge and consent. In particular, the attitude towards the presumption of consent to the removal of organs and tissues, which is implemented in the activities of medical institutions, is demonstrated.
