Legal regulation of the use of observation in the investigation of criminal cases in the statute of criminal proceedings of the Russian empire

The provisions of Criminal proceedings Charter of 1864, regulating the examination at the pre- trial stages of the criminal procedure, are analyzed in the article. The opinions of pre-revolutionary proceduralists, pointing to the existing problems of law enforcement by criminal prosecution bodies during investigative action, are considered. The attention is focused on individual derogations from the provisions of the legislative procedure for the examination by investigators, which were included in the criminal procedure law as a rule of law over time.
