Legal nature of the insurance contract in the pre-revolutionary period of its formation

Purpose: An attempt to resolve the problems of doctrinal definition of the legal nature of the insurance contract and to bring legal certainty to the insurance relationship. Methodology: By the author it was used historical and legal and formal-legal methods. Results: As a result of the research the author highlights the main historical-scientific concepts jurist scholars, defending his views on the legal nature of the insurance contract. It was determined that the institution of the contract of insurance is unique in its kind, is an independent legal nature and occupies a special place in the science of civil law, as well as in the Russian legislation. Novelty/originality/value: The paper has a high scientific value, since it is one of the first scientific papers, are an attempt to understand the legal nature of the insurance contract, starting from the origins of its formation and fixation in Russian pre-revolutionary right.
