Legal thinking in the structure of legal ideology (gnoseological aspect)

Бесплатный доступ

The specificity of the basic element of legal ideology - legal thinking based on the analysis of its structural levels - is investigated. It is shown that the ordinary level of legal thinking is based on sensory experience, realized in axiological and value judgments about law. At the scientific-theoretical and professional levels of legal thinking, abstract-mental knowledge of legal reality prevails, where developed intellectual intuition plays a big role. It is noted that a prerequisite for the formation and development of legal thinking is the presence of a cognitive interest in knowledge about the fundamental principles of law and the mechanism for implementing legal decisions.
